CBRE data master to step down KAY LICATA – ‘A PIONEER’ – RETIRES AFTER 25 YEARS

BY BILL FALLON bfallon@westfairinc.com IN THE WAKE OF THE IBM RETREAT from central Westchester County in 1990, GMAC came into possession of a number of buildings on Westchester Avenue. Edward S. Gordon Co., which would eventually, as Insignia, merge with CBRE with regional offices in Stamford and New York City, was hired to manage the portfolio from an office at 925 Westchester Ave. So began a 25-year relationship between CBRE and a trilingual graduate of the University of Casablanca — Kay Licata — brought aboard to corral

and analyze what turned out to be at times chaotic data spread across the Interstate 287 corridor between White Plains and Harrison. As she prepares to leave the company, her job title is director, research services, CBRE Inc. She spoke recently from the company’s Stamford office. “This was pre-Internet,” Licata said, reflecting on her first task. “We made a lot of phone calls. We visited a lot of buildings. And we built a database. We had a large portfolio. We were working very hard and the only thing we had to do was take care of this asset for GMAC. CONNECTICUT THROUGH A NUMBER OF EFFORTS that include Small Business Express

and a pair of programs targeting manufacturing is focused on creating and retaining jobs. While private-sector lending can be dictated by the bottom line, the state Department of Economic and Community Development and Catherine Smith, its commissioner, by design seek longer-term results from business financing, namely, “How are they going to recover, sustain themselves, grow and create jobs?” The Fairfield County Business Journal put a series of questions relating to finance to Smith via email as the second part of a two-part finance series. Connect Innovations, which assists the state’s technology sector with financ-

ing, was the subject of part 1, “CI spurs tech companies at liftoff and beyond,” FCBJ, Jan. 26. FCBJ: Small-business financing — whether for working capital, equity investment or purchases — took a hit in the recession. How has today’s financing landscape been altered? SMITH: “At the time it was created, the Small Business Express program (known as EXP) addressed a real market need — the private sector had dramatically tightened lending in the wake of the Great Recession — and that was hindering many small-business people who were trying to recover from the recession and grow. EXP was designed to help our Main Street companies get back to business. “While access to capital has become better, the effects of the recession are still felt by many businesses, especially the smaller ones, » DECD, page 6

Battery-charging startup wins pitch contest BY ALEXANDER SOULE Hearst Connecticut Media

A

Stamford startup won a pitch contest sponsored by the Stamford Innovation Center and the Angel Investor Forum, promising a newfangled business model for electric vehicles. Talino EV planned to launch in midFebruary, after press time, but its founders gave a preview of its business at the Feb. 5 Startup Pitch Night competition at the Stamford Innovation Center. CEO Henry Abreu and cofounder Marc Ira have brainstormed a system of “smart” battery packs that would function akin to prepaid cellphones, charging a small payment each time an electric vehicle’s battery is recharged. Spreading out the cost of the battery over time puts the upfront sticker cost of the electric vehicle itself in line with gas-powered counterparts. Abreu and Ira believe that in turn will jumpstart sales of electric vehicles, which can cost thousands of dollars more than regular cars. Talino EV is focusing initially on the Philippines, where millions of gas-powered motorcycles — dubbed tricycles there — spew pollution. “Talino enables on-demand, necessary, short-distance, clean high-technology transportation,” Ira told an audience at the Stamford Innovation Center. “If this sounds familiar, it is because this is the strategy Uber is using to go global ... We believe that we offer a lot more to our client base — and we believe we have a lot more clients in our client base.”

Talino EV envisions two revenue streams — manufacturing the smart battery packs that electric vehicle makers would install, and then recurring revenue from vehicle owners replenishing their batteries. Abreu and Ira did not outline what a vehicle owner could expect to pay as calculated by the mile or kilometer. Over time, Abreu said the company would make “multiples” of the upfront cost of manufacturing the battery. Talino EV beat out four other entrants, with the runner-up prize awarded to Optical

Academy, which offers low-cost vision appraisal and eyeglasses to schools in New Jersey, where it is based, and other states. Optical Academy is working out deals with teacher unions to bring advanced visiontesting systems to schools, at a cost of about $30 for the assessment and another $30 for the eyeglasses. Founder Abby Ayoub said that easily undercuts what families would pay through their insurance or otherwise to get their kids tested and fitted for glasses. Ayoub said Optical Academy has yet to

begin operating in Connecticut, but expects to do so “soon” and will likely seek a franchisee to offer the service here. The Stamford Innovation Center and the Angel Investor Forum do not award much in the way of cash — $1,000 for first place, $500 for second — but offer a good opportunity for entrepreneurs to hone their presentations. “If we can incent startups to work on delivering great, concise presentations, we’re convinced the quality of startups overall will » » BATTERY, page 4

Stratford looks to ride the rails into the future

lanes for bicyclists, improvements for pedestrians and measures to calm car traffic within a half-mile radius around the depot. Green infrastructure best practices also will be incorporated to improve air, soil and water quality and protect the town from flooding, town officials said. “A transit-oriented focus to developing

Stratford Center will bring much-needed foot traffic and could lead to additional parking and opportunities for the many small businesses there,” Mayor John A. Harkins said in a statement. “The transit-oriented development outgrowth will relate to the town’s plan of conservation development, which was unanimously

approved by the planning commission in 2013.” Town officials said the transit-oriented district is an attempt to spur economic development and revitalize the neighborhood for residents, commuters, businesses and visitors. — Crystal Kang

Starwood plans to spin off its timeshare business

tamford-based Starwood Hotels & Resorts Worldwide Inc. said in a press release it is spinning off its 22 timeshare resorts into a separate and publicly traded company. That business, Starwood Vacation Ownership, had revenue of about $640 mil-

lion last year. It has sold more than $6 billion worth of timeshares to more than 220,000 buyers over the past 30 years, Starwood reported. Starwood on Feb. 10 said the new company will establish long-term license agreements with Starwood to maintain affiliation

with the Westin and Sheraton brands. Starwood, in the statement announcing the move, said it will transfer additional assets at Westin Los Cabos, Westin Cancun, Westin Puerto Vallarta, Sheraton Kauai and Sheraton Steamboat to the new company for timeshare development.

The company, which has yet to be named officially, will maintain its headquarters in Orlando, Fla. Matthew Avril, 54, who retired as president of Starwood’s hotel group in 2012, will become CEO. The spinoff is expected to be completed by year’s end. — Bill Fallon

or 30 years, Greenwich-based HB Nitkin Group has focused on turning undervalued commercial properties into mixed-use developments that would capture and retain reliable business tenants. When Helen Nitkin started the company with her now-deceased husband, Bradley, in 1984, the couple envisioned buying dilapidated commercial properties in New York and Connecticut, redeveloping them and repositioning them as prime retail and office spaces. In recent years, the company has faced the challenge of finding retailers willing to move into newly vacant spaces in Westport. “What we’re not seeing so much anymore is fashion and retail,” Nitkin said. “Retail congregates on Greenwich Avenue, in New York City and in the malls. But there aren’t a lot of fashion retailers opening in small towns.” Westport’s Playhouse Square has the lowest occupancy rate of the properties in the company’s portfolio, while a companyowned Southport property at 2600 Post Road has maintained 100 percent occupancy for a number of years. The bulk of the firm’s portfolio consists of the retail and fashion districts of Greenwich and Westport. Nitkin, who took up two large projects in Hartford and Greenwich when her husband fell ill in 2006, said the highest valued projects include the new Front Street District in Hartford, the Shops at Somerset Square in Glastonbury and Greenwich Avenue retail in Greenwich. Nitkin, who took over the business after Bradley Nitkin died in 2009, said the plan is to further invest in Hartford through a multiphase redevelopment project, which includes a restaurant-and-entertainment setting built in 2011; a 121-unit apartment building, which is under construction; and the third phase, which would create 20,000 square feet of retail in the years to come. HB Nitkin Group, which maintains 13 properties in its portfolio, has an overall 92 percent occupancy rate. Its 80,000-squarefoot Greenwich Financial Center possesses 65,000 square feet of office space, with

tenants, including Morgan Stanley, and 15,000 square feet of street retail, including its anchor tenant Soul Cycle. Although Nitkin said the properties in her company’s portfolio don’t accommodate many startups, she is willing to accept individuals who are pursuing another startup idea after leaving their own businesses. But, she suggested, “Make sure you put in a tenant who has staying power — someone

be the best at what you do.” She described her work as “wonderful,” her work history as “the most beautiful.” Licata is f luent in Arabic, French and English and uses all three regularly: conversing with family weekly in Europe and Morocco. A one-hour conversation with her remains lively across topics like absorption because Licata makes it so. She is a mainstay of CBRE roundtable events, where her data are front and center. She enjoys a glass of wine and anticipates taking up golf in retirement. She describes herself as “very social.”

The Stamford Innovation Center gave Arccos co-founders Sal Syed and Ammad Faisal its Abraham Davenport award as the “most fearless” local startup leaders, with the Stamford-based company selling a system in the Apple Store to help golfers track shots and improve their game. And the John Mackie Brown award

went to Orthozon Technologies’ CEO Joshua Aferzon as the “hardest working leader of a startup” in the iCenter’s orbit. Stamfordbased Orthozon has developed a retraction tool for spine procedures and other surgeries that allows for smaller incisions, improving recovery times for patients. Aferzon had a word of advice for the entrepreneurs who competed in the contest. “It’s a lot of hard work to build a company – it takes a long time and it takes a lot of ‘no’s,’” Aferzon said. “When you are an entrepreneur, it’s not just ‘no’ — it’s not just ‘we’re not interested, we’re going to move on,’ It’s ‘no’ and a list of reasons as to why you are going to fail — every single time.”

Young workers flee county in droves BY HUGH BAILEY

“People are having less children, and they may be put off by having a large home and a high mortgage,” he said. “People are nervous as a result of the housing crisis, and maybe were burned by the housing crisis. They may be not wanting to take on debt, or maybe they’ve been having issues getting a mortgage.” In response to declining numbers of young workers, many towns and cities in southwestern Connecticut have put more focus on their downtowns, with an emphasis on walkable communities with easy access to transit stops. Bridgeport and Stamford each have an established urban core, and farther-out towns like Trumbull and Shelton also are emphasizing the need for non-cardependent development. “From 2011 to 2013 in Fairfield County, the number of people in owner-occupied units dropped while the number in rental units has risen,” said Richard Park, who analyzes data for Fitch.

T

here’s a good reason why so many area towns and cities are fixated on their downtowns. It may be the best way to arrest a startling drop-off in the young working-age population in southwestern Connecticut. According to data from Fitch Ratings, the number of residents in Fairfield County from 35 to 39 years old declined 26.5 percent between 2000 and 2013. Numbers also fell precipitously in the 30-to-34 and 40-to-44 age ranges, while rising among all other working-age groups. The reasons for the drop are many. “It could be a cyclical thing, where trends in terms of where people want to live have changed,” said Kevin Dolan, who analyzes towns in Fairfield County for Fitch. “In the past, it was maybe more the large suburban home, with large property,” that people were looking to buy. “It might be different now, maybe more of a downtown setting, more urban, closer to work, with less commuting.” Environmental issues have taken greater precedence for many people, he said, with the ability to walk or bike to work seen as desirable.

MORE SENIORS, FEWER CHILDREN

While some of the working-age population is declining, the numbers of older workers are surging, Fitch’s data show. From 2000 to 2013, the 60-64 contingent increased by

half, with the 55-59 group up by 42.7 percent. It may be a reflection of the type of housing available in this region and who can afford to buy it, analysts said. But an older population won’t necessarily mean a drain on services, because it tends to be a high-income group, Dolan said. “Much of the population is seen as highnet-worth and can afford insurance,” he said. “They tend to be higher wealth and can afford services, and so are not a drain on the economy.” Though the 65-plus age group as a whole grew by 14.1 percent since 2000, faster than other age groups in the region, it still lags the rest of the country, where the senior population increased 27.8 percent. As the last of the baby boom generation turns 50, those numbers are expected to stay high for years to come. “The smaller numbers in the 65-plus range point to maybe as people get to retirement age, they may move out of state,” Park said. “It may not be growing as quickly here because retirees move to more tax-beneficial states, like Florida.” As the numbers for senior citizens will keep rising in years to come, they aren’t being

matched by the youngest contingent. Children from birth to 19 increased by only 2.4 percent in Fairfield County since 2000, nearly matching the national rate of 2.2 percent. Having fewer younger adults in the county contributes to that trend. “It might coincide with that 30- to 40-year-old population drop, with that the likely age for having children,” Dolan said. “We’re seeing the trend toward less children in most families or waiting until they’re older. Dual-income families tend to have children later.” For the youngest group, the drop-off is starkest. “It’s been a statewide trend,” Park said. “From 2000 to 2013 in Connecticut, the under-9 population dropped 12.9 percent; in Fairfield County it dropped 10.8 percent.” That’s having an impact on school districts statewide, where nearly every town is predicting declining numbers in coming years. “We are seeing those projections of a decline in future enrollment,” Dolan said.

so demand for EXP continues to be strong.” FCBJ: What is the best advice for small businesses seeking financing? Is there any action they can take either to ensure a loan’s approval or to keep a loan’s interest rate low? SMITH: “A strong balance sheet and consistently positive cash flow are always important to lenders. In this market, projects investing in capital equipment, where financing is secured with physical property, are often favorably reviewed. And it is generally a baseline requirement that the company have no unresolved issues with other lenders or governmental agencies. “With respect to EXP, there are some important factors to keep in mind. Our staff goes out of its way to work with individual businesses to structure terms that will work — EXP’s purpose is to help small businesses grow — and sometimes we will help structure the loan so that the company has the ability to build up its business and tier interest payments that align with this cash flow. “EXP also offers forgivable loans to companies seeking to grow — transforming the loan to a grant if the company succeeds in creating and sustaining jobs. “EXP, like all financial assistance programs that DECD manages, is focused on the creation and retention of jobs — this is also a key characteristic that differentiates what the agency does from private-sector lending. Fairfield County lagged the nation in job creation and wage growth for much of the time period in question, leading many people to look elsewhere. “Since the recession, Fairfield County job recovery and Connecticut as a whole has lagged the nation,” Park said. “That would point you to believe people are naturally going to have to find jobs where job creation is stronger.” But there could be signs of a turnaround. “Job growth in Fairfield County prior to 2013

of assistance: grants of up to $100,000, with a company match of at least 1-to-1 required; job creation loans of up to $300,000 that are partially (up to 50 percent) forgivable, based on the number and type of jobs created; and working capital loans of up to $100,000. “While EXP represents the largest number of assistance agreements, we often work with companies that have more than 100 employees and expansion projects costing millions of dollars. These companies are funded through the Manufacturing Assistance Act, or MAA. Again, the terms are flexible and forgiveness provisions based on new job creation. “For very large projects, where a company plans to add 200 or more jobs and make a substantial capital investments, we utilize the First Five program — a mix of tax credits, forgivable loans and small grants tailor-made for each First Five recipient. “The Manufacturing Innovation Fund (MIF) is our newest program. It focuses on

manufacturing companies that are innovating, commercializing new technologies or advancing their workforce in advanced manufacturing technologies. The first initiative for this fund is a voucher program that subsidizes the cost of specialized technical assistance for manufacturers. The fund is expected to announce additional initiatives later in the year that are geared at talent development and training.” FCBJ: What is the department’s economic development strategy for the state as it relates to small-business finance? SMITH: “We believe that small business is often the engine of growth in our economy. That’s why we created the EXP program and why we work with many partners across the state to ensure our business community has access to capital, technical assistance and a strong business environment. “In addition to financing programs, DECD has long-standing relationships with partners like Small Business Development

was extremely modest,” Dolan said. “But it has picked up tremendously in 2014,” he said, meaning some of the migration trends could be shifting. “Connecticut housing prices have lagged other states, as well, and that is starting to turn around,” he said, adding that lower housing values could have the benefit of attracting buyers into the region. While Fairfield County is viewed as expensive compared to most of the country, it can be a bargain next to neighboring Westchester County, N.Y., and New York City, which helps explain positive net migration numbers from those locations. “There are most likely cost factors at

play, because moving to Connecticut can be a positive in terms of income or property tax from New York City and Westchester,” Park said. “For some moving out of New York City, it’s people who want to get to a more suburban area, and that plays a part, as well. Fairfield County is clearly a desirable place for commuting.” And trends that have seen younger adults moving out in droves may not last much longer. “We’ve looked at the numbers all through 2013, and we’re starting to see a turnaround in job growth, with the unemployment rate going down, across the state,” Dolan said. “Housing prices are starting to turn that

SMITH: “The campaign has been very successful — an award-winning program that has generated impressive shifts in perception about the state since we launched in the spring of 2012. We’re building credibility and recognition — and our latest ads (both online and in traditional media) feature leaders from Connecticut Fortune 100 companies to Main Street businesses explaining why Connecticut is a great place to do business. With this campaign alone, we have seen our survey scores rise as much as 72 percent in viewers’ perception of the state as a ‘dynamic and innovative place’ and ‘a great place to relocate to.’” FCBJ: You are hosts of a new website that ties together resources irrespective of origins. What is the address and what does it do? Is it easy to use and is it working? SMITH: “Yes, we are in the process of creating a new business portal that will provide a much more user-friendly interface for businesses to access the services and support they require to start and grow their business in the state. our branches of the Federal Reserve Bank have jointly released findings from their annual small-business credit surveys. The Joint Small Business Credit Survey Report, produced from data compiled by the Federal Reserve branches in Atlanta, Cleveland, New York and Philadelphia, revealed varied demand for credit across businesses grouped by size, as well as significant difficulty for smaller businesses. The survey split small businesses into four categories. It defined businesses with less than $250,000 in revenue as microbusinesses, while small businesses were defined as having revenues between $250,000 and $1 million. Midsize firms have between $1 million and $10 million in revenue, and commercial firms have revenues greater than $10 million. Funding continues to be difficult to obtain for firms in the microbusiness and small-business categories, with 52 percent of microbusinesses and 50 percent of small businesses surveyed reporting they received none of the financing they had applied for.

Another 11 percent of microbusinesses and 10 percent of small businesses got less than half of the financing they sought. Matthew Carey, the director of the Center for Financial Market Studies at Iona College in New Rochelle, N.Y., said he does not find the results surprising. “Nascent businesses always have trouble, and it’s always tougher because it’s not bal-

Sixty percent of midsize businesses received all the funding they applied for and 70 percent of commercial businesses got all the funding for which they applied. Just 20 percent of commercial businesses and 14 percent of midsize businesses applied for credit and received no funding. Larger business had greater demand for credit than smaller businesses. While 22 per-

For firms seeking financing, almost 40 percent of the firms surveyed said the primary purpose for the funding sought was to

expand their business. Small firms primarily turn to large national and regional banks for financing, but almost one in five applicants applied to an online lender in the first half of 2014. Approval rates were highest at large and small regional banks and online lenders. Of firms that applied to a small regional or community bank, 60 percent were approved for at least some of the financing sought. “Banks went through 15 years of consolidation and that took the focus off the smaller end of the market,” Carey said. “The big banks made the decision that it’s not a profitable segment, so they put their balance sheets to work on the higher end. Lending to that segment takes time, it’s difficult to automate, and they are constantly monitoring the credit.” In the near term, Carey said he sees alternative lenders like OnDeck Capital and Lending Club filling the void for lending options for small businesses. “When you see companies like OnDeck and Lending Club gearing up to go public, they see an opportunity,” Carey said. “They’ll concede the high-end market to the banks, because they’re not after that market.”

Enlist a team of leaders to avoid micromanaging Someone suggested recently that I spend too much time plugging holes and fixing problems. I thought it was my job as owner to ensure things run well. I realized that I’m not my staff’s backfill; they are my backfill. Can you help me get my head around this change? THOUGHTS OF THE DAY: A pyramid cannot stand on its point; it needs to stand on its base. Build your pyramid by building a group of strong, cross-supporting people under you. Expect people to help each other become leaders. Unleash results that come from people who accountably and willingly deal with difficulties and challenges. Take the weight off your shoulders by stepping back. Think of your company as a total structure made up of individual blocks, built up from foundation to pinnacle. No one block could hold up the entire structure, but when set together in a common structure, interlocked, cross-supporting, they create one of the strongest structures on the planet — a pyramid. Give people more opportunity to come up with answers, not less. Give them more room to crack open problems, inspect details and learn by making mistakes as they strive to develop winning solutions. Hold everyone, individually and as teams, accountable. If they come to you for answers, provide guidance but challenge them to develop their own solutions. Your goal is to have a group of people who see themselves as colleagues serving a common mission, each leading in their own way while collaborating to achieve common results. Build a team of people who are ready to lead and able to back up each other. That gets you free from the drudgery of the day to day. That means more time for you to work on the strategic opportunities and long-term development of the business. Develop leaders by treating all the people in your company as leaders. Foster leadership by giving people control over decision-making. Ask people to brainstorm together how to get the company where it needs to go. Put everyone in charge of protecting and nurturing the organization’s

future. There should be no more looking to one person for a solution. Make it clear to everyone that they are in it together. If they work as a group, collaborate and support each other, they will tackle more issues, identify more opportunities and come up with better overall solutions. When team members back off of a problem or get stuck, have them reach out to each other rather than coming to you for the answers. Facilitate conversations, if necessary, by asking team members to gather. Instead of playing a director role in the conversation, sit back and watch how the dialogue unfolds. Ask pointed questions if you think the group may be missing

something: “What about … ?” “What if you tried … ?”. Then back out and let the team work on solving the problems. Do provide an overall framework: “We need to be on a mission this year to achieve a, b, c.” Then ask everyone to come together to create their plan, detailing the goals and actions they believe will lead to the accomplishment of that mission. Think of it as laying out a challenge, and let the group formulate how they think that challenge can best be met. Encourage people in the company to form many teams, or mini pyramids, breaking down barriers to cooperation and collaboration, in order to accomplish the work ahead. People working across

Aquarium buys catamaran for quiet cruises BY BILL FALLON bfallon@westfairinc.com

sk a co-worker to pass the crab at an after-hours gathering and it likely arrives on a cracker with a dusting of Old Bay Seasoning. Beginning this spring, such a request in Norwalk might lead to a pinch on the fingers. Now undergoing sea trials, the 64-foot R/V Spirit of the Sound — R/V for research vessel — purchased in September by The Maritime Aquarium at Norwalk, will soon become available for business cruises. The boat begins with weekends in May and jumps to daily trips this summer with Friday night social cruises planned. Its capacity is 60, with a crew of 10. The twin-hulled catamaran is built to accommodate educational and social outings, according to aquarium spokesman Dave Sigworth. He said a typical trip will run about 2 1/2 hours out into the Long Island Sound. The Spirit of the Sound’s $2.7 million price tag was covered entirely by private and philanthropic donations. The Spirit of the Sound replaces a 40-foot diesel trawler, R/V Oceanic, which could accommodate 29 passengers. Sigworth said the Oceanic was, by its diesel nature, a loud boat, but Spirit of the Sound is powered by a hybrid diesel-battery system where the batteries are charged by the engines. Sigworth said the hope is to complete the cruises entirely on battery power. Once dockside, the boat can be plugged in to recharge.

strates The Maritime Aquarium’s leadership in this area and how to do it well.” Among the species the boat will catch for study and then release are skates, squid, dogfish sharks and four kinds of crab: horseshoe, blue, spider and rock. “We sort them out,” Sigworth said. “Blue crabs are the ones you see swimming near piers. They pinch pretty hard.” The Spirit of the Sound is also equipped with a robot with a camera to explore wrecks and octopuses’ gardens. But the views will not be the ones TV viewers have come to expect from the Titanic. The Long Island Sound is rich with plankton, Sigworth said, which prevents crystal-clear, long-shot views such as are available 2 miles down. The boat is now docked at the Cove Marina in Norwalk. It will move to the aquarium dock, which is undergoing renovations, this spring. While it obscures, the plankton is also the basic nourishment at the bottom of the food chain. When plankton die, waters

become so-called dead zones, victims of low oxygen levels: hypoxia. Sigworth said “just about the entire state” and all 11,260 square miles of the watershed of the Connecticut River between the sound and Quebec send rain and snow water to the sound. Thousands of acres of lawns, agriculture and golf courses add their fertilizers to the mix, feeding algae and helping to set the stage for dead zones. Sigworth said a ride on the boat comes with the message that we are all stewards of the sound. “Anyone who is within the sound’s watershed is responsible for its health, so no one feels responsible,” he said. He drew a line between a fertilizer-applying homeowner and a Chinese proverb wherein no single drop of water feels responsibility for a flood. “This boat will double the business of the previous boat and double the awareness people gain by going out,” he said. Inspiring the Next Generation of Dancers Founded in 1998 as a nonprofit, the Ballet School of Stamford is unique in the Fairfield County region. The school works to provide an excellent dance education to students, regardless of their financial situation. Teaching children compassion, discipline and instilling the feeling of success earned from hard work in a safe and encouraging environment are the touchstones of the school’s program. The arts have become a luxury for too many children in our region. Schools have cut their arts offerings and many after-school programs are out of reach for many families. The Ballet School of Stamford is successfully filling this gap by offering scholarships and free performances at a variety of venues to expose students to high-quality dance education. The school has earned a reputation of nurturing young dancers through a disciplined and focused training program. The faculty is a dedicated and knowledgeable group of professionals who are passionate about teaching. Currently 280 dancers ages 3-20 years old attend classes in its studios in Stamford’s historic Old Town Hall along with adults in ballet, barre and yoga classes. The Ballet School of Stamford’s outreach program, “Dance for All” began when the school was founded and now provides $100,000 a year in scholarships to deserving families. One of the school’s main points of pride is that 100 percent of its graduates over the last 10 years have gone on to college, including those who have gone on to dance professionally. The school’s next performance is “Next Generation,” Feb. 28, at the Palace Theatre, produced with partners Curtain Call, PROJECT MUSIC, Stamford Center for the Arts, INTAKE Organization and Loft Artists Association. Housatonic Museum Features the Work of Rick Shaefer The Housatonic Museum of Art presents “Rick Shaefer: Drawing the Line” now on view in the Burt Chernow Galleries, through March 27. Rick Shaefer, of Fairfield, maintains a studio at The Nest in Bridgeport. He studied painting at Duke University and then took up the study of photography at Art Center College in Los Angeles. After art school, he moved to New York City and opened a photography studio specializing in fashion and photo illustration working primarily for magazines as well as designing book jackets, album covers and movie posters. Since the 1990s, Shaefer has devoted his time exclusively to painting and drawing and he is represented by the Sears Peyton Gallery in New York City. His monumental, breath-taking drawings offer viewers an adventure in looking with his technically precise and visually poetic drawings of animals and nature. These powerful and confident drawings circle around a common theme: the effects of human activity on nature. The Housatonic Museum of Art (HMA) is home to one of the premier college art collections in the United States. Not only does SB 106 make an employer guilty-untilyou-prove-yourself-innocent in workplace complaints involving immigrant employees, it also contains a few additional sections rendering courts powerless to award anything less than double wages plus overtime wages in civil actions over pay disputes. The bill purports to protect immigrants, but it has several major flaws—not least among them, the fact that it’s preempted by federal law. The federal Immigration Reform and Control Act of 1986 controls all aspects of immigration employment— especially enforcement. That’s why Arizona’s attempt to unilaterally enforce certain immigration laws was struck down by the U.S. Supreme Court in 2012. Second, SB 106 assumes a business is guilty of retaliating against an immigrant employee until the employer proves itself innocent. Fines, losses of licenses, and other penalties would be levied on any employer taking an immigration-related action within 90 days against an employee who has

made a workplace complaint. Innocent businesses would have to expend considerable financial resources and effort to defend against meritless claims. Finally, SB 106 is redundant because of employee retaliation protection laws that are already on the books in Connecticut. Nearly every chapter of Connecticut’s labor and employment law already contains provisions protecting employees from employer retaliation. SB 106 also takes away a judge’s discretion to award less than double damages in a civil action to collect unpaid regular and overtime wages. What is gained by mandating double damages when a judge already has the power to impose the penalty on truly bad-acting employers? Could the answer be that it is to make the penalty so harsh that employers would be forced to settle wage disputes every time, even when the employer believes they did nothing wrong?  Read more at gov.cbia.com

Chemicals Bill: Wrong Formula for Connecticut well intentioned but flawed proposal designed to create a Connecticut-specific list of potentially harmful chemicals was the subject of a recent public hearing by the legislature’s Committee on Children. HB 5653 requires the state Department of Public Health (DPH) to develop and regularly update a list of chemicals the agency believes are potentially harmful to children. It also requires DPH to test and recommend regulating, restricting, or banning the sale of products containing the chemicals in Connecticut. While well intentioned, the bill has significant flaws. First, it conveys the impression that children in Connecticut are not already adequately protected, despite myriad federal laws, regulations, and standards. Second, the bill assumes DPH can do a better job of testing and evaluating chemical toxicity and

acceptable exposure levels than top regional and national toxicology experts conducting rigorous scientific, peer-reviewed studies. While DPH does have a handful of staff experts in one or more aspects of toxicology, the constant task of evaluation and assessment required by HB 5653 would overwhelm them—and is unnecessary given the enormous federal and academic research dedicated to protecting the environment from potentially toxic chemicals. Third, the bill fails to recognize the unintended and harmful economic impact of creating a Connecticutonly list of chemicals, subject to change at least every two years and with regulatory changes occurring at least as often. Employment at will means that an employee can be fired at any time, with or without advance notice, for any reason or no reason, as long as it’s not for an illegal reason. Relying simply on Connecticut’s status as an employment-at-will state to justify a termination, however, should be a last resort. Rather than asking if it’s permissible to fire someone without giving a reason, the more useful question is whether it’s advisable to fire someone without offering a reason. Think about it from the employee’s perspective. Nobody is fired for no reason; something has to have occurred to trigger an employer’s decision to let someone go—for example, a business-related incident or development or something pertaining to a worker’s performance or behavior. If no reason is given to the worker, he or she is likely to suspect that disclosing the real reason would pose a problem for the company and that management must be trying to hide the real (possibly illegal) reason by using at-will employment as a shield.

Since Connecticut is an employmentat-will state, do we need a specific reason to fire someone?

Illegal reasons for firing someone include discrimination—for example, terminating an employee because of his or her race, religion, national origin, gender, pregnancy, sexual orientation, gender identity, or disability. It is also illegal to fire someone as retaliation for doing something he or she has the legally protected right to do. Other restrictions on your right to fire an employee may come from a union contract, personnel policy, or employment agreement that specifies reasons or procedures that must be followed before firing someone. In approaching an employee termination, treat the employee with respect and provide a reason that reflects the truth. It does not have to include exhaustive, explicit details, nor should you expect the employee to accept or agree with your decision. Of course, the employee may dispute your decision, but in most cases, the truth will set you free—both from legal claims and, very often, a troublesome worker.  Read more at cbia.com/hr
